These Terms of Service (“Terms”) govern your access to and use of the Pledge mobile application and related websites and services (collectively, the “Services”). By creating an account or using the Services, you agree to these Terms.
1) Who we are
“Pledge”, “we”, “us”, or “our” refers to the provider of the Services. Contact: contact.pledge@gmail.com. Our Privacy Policy forms part of these Terms and is available at /privacy.html.
2) Eligibility
- You must be at least 13 years old (or the age of digital consent in your country) to use the Services.
- You must have the legal capacity to enter into a binding agreement and comply with these Terms.
- Where required by law or our payments partner, you may be asked to complete identity checks (KYC/AML).
3) Accounts & Security
- Keep your login credentials confidential. You are responsible for all activity under your account.
- You agree to provide accurate information and to promptly update it.
- We may suspend or terminate accounts that violate these Terms or applicable laws.
4) Challenges, Entries & Outcomes
- Pledge provides tools to create or join self‑improvement challenges with friends. Challenges are skills‑based and not games of chance.
- Creators define rules, verification methods, and timeframes. Participants are responsible for submitting accurate progress updates.
- We may intervene to resolve disputes, but final outcomes may rely on creator/admin decisions and documented rules.
5) Payments, Custody & Payouts (Wise)
- Deposits are currently accepted via bank transfer. We use Wise to hold challenge pots in custody and to pay out winnings.
- For payouts, you may be asked for bank details (e.g., account holder name, BSB/sort/routing, IBAN/account number). Where possible, full details are stored by Wise; we keep only a token and limited descriptors. If we must collect details temporarily to transmit to Wise, we encrypt them and delete them after successful transfer.
- Card payments are planned but not yet available.
- Fees and currency conversion charges (if any) are disclosed before you confirm a transaction. You are responsible for any local taxes.
- We may delay or decline payouts to comply with law, prevent fraud, or complete required checks.
6) Refunds & Cancellations
- Deposits into a challenge pot are generally non‑refundable once the challenge begins, except where required by law or if the challenge is cancelled before start.
- If a challenge is invalidated (e.g., due to rule violations or technical issues), we may issue pro‑rata refunds or re‑allocate funds at our reasonable discretion.
7) Acceptable Use & Community Standards
- No illegal activity, harassment, hate speech, or threats.
- No cheating, fraud, manipulation, or submitting false evidence.
- No posting content that infringes third‑party rights or violates privacy.
- We may remove content or restrict accounts that violate these standards.
8) Intellectual Property
- The Services, including our brand, software, and content, are protected by intellectual property laws. We grant you a limited, non‑exclusive, non‑transferable license to use the app for personal, non‑commercial purposes.
- You retain rights to content you submit. You grant us a worldwide, non‑exclusive license to host, display, and use that content solely to operate and improve the Services.

We integrate with third parties such as Wise (custody & payouts), Apple (in‑app analytics, distribution), and hosting providers. Use of third‑party services is subject to their own terms and policies.

To the maximum extent permitted by law, Pledge and its affiliates will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for losses of profits, data, goodwill, or other intangible losses arising from or relating to your use of the Services. Our aggregate liability will not exceed the greater of (a) the amounts you paid to us in the 6 months preceding the event, or (b) USD 100.

You agree to indemnify and hold harmless Pledge and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.
13) Termination
You may stop using the Services at any time and request deletion of your account. We may suspend or terminate your access for any reason, including violation of these Terms, abusive behavior, or legal/compliance reasons. Certain provisions survive termination (e.g., payments, IP, disclaimers, limitations of liability).
14) Governing Law & Disputes
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict‑of‑laws principles. You agree to the exclusive jurisdiction of the courts located in [Your City/Region]. Where permitted, disputes will first be addressed through good‑faith negotiation; if unresolved, either party may seek relief in the courts above.
